- ACCEPTANCE OF TERMS

1.1 Acceptance of Use.
By accessing or using our website/app (“the Service”), and by making a reservation or booking (“Booking”), you (“you”, “Guest”, “User”) agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree, do not use or access the Service. Continued use after updates constitutes acceptance of the updated Terms.
1.2 Rooming Joe does not own, manage, or control the accommodations listed on the Platform.
Providers are independent entities responsible for their listings, services, and compliance with laws.
- DEFINITIONS
2.1 “Platform” or “Service”
Rooming Joe’s website, mobile app, APIs, messaging system, and booking tools.
2.2 “Guest”
A user who books accommodations.
2.3 “Host” or “Provider”
A person or business offering rooms, apartments, dorm beds, hostels, hotels, or other accommodations.
2.4 “Listing”
A posted accommodation including pricing, details, rules, and availability.
2.5 “Booking”
A completed reservation made by a Guest through the Platform.
2.6 “Contract”
The legally binding agreement between Guest and Host/Provider formed upon Booking confirmation.
2.7 “Service Fees”
Fees charged by Rooming Joe for using the Platform.
- ROOMING JOE’S ROLE
3.1 We act as a platform connecting you with accommodation or travel service providers both individuals and businesses.
3.2 We are not the provider of the accommodation/travel services themselves (unless explicitly stated), so any contract for stay/services is directly between you and the Travel Provider / Host. We only facilitate the connection and help you and the business exchange services.
3.3 Rooming Joe provides-
3.3.1 A marketplace for Guests to discover accommodations.
3.3.2 Tools for Hosts/Providers to list offerings.
3.3.3 Payment facilitation and booking management.
3.3.4 Messaging tools between Guests and Hosts.
3.4 Rooming Joe is not a party to accommodation contracts. The agreement is between Guest and Host, not Rooming Joe. Rooming Joe-
3.4.1 Does not control the quality, safety, legality, or availability of Listings.
3.4.2 Does not guarantee accuracy of Host-provided information.
3.4.3 Is not responsible for overbookings, property issues, or Host misconduct.
3.4.4 Is not a real estate broker, travel agency, or property manager.
- ELIGIBILITY
To use Rooming Joe, you must:
4.1 Be at least 18 years old
4.2 Have legal capacity to enter a contract
4.3 Provide accurate account information
4.4 Not be barred by applicable laws.
4.5 Use of the Service must be for lawful, personal (non-commercial) purposes.
4.6 All information you supply (e.g. for booking) must be accurate, current, and complete.
- ACCOUNT CREATION
Users must maintain:
5.1 Accurate personal information at all times.
5.2 Secure login credentials.
5.3 A single account unless authorized.
5.4 Compliance with Platform rules.
Rooming Joe may suspend or terminate accounts for violations.
- LISTINGS
Hosts/Providers are responsible for:
6.1 Accurate descriptions, pricing, availability
6.2 Up-to-date photos and amenities
6.3 Disclosing taxes, fees, and rules
6.4 Compliance with all laws, permits, zoning, and safety standards
6.5 Responding to inquiries in a timely manner
Rooming Joe is not responsible for Host-created content.
- BOOKINGS & CONTRACT FORMATION
A Booking is confirmed when:
7.1 Guest receives a Booking confirmation email/app notification.
7.2 Payment is authorized or charged (depending on policy).
At that moment:
7.3 A Contract forms between Guest and Host/Provider.
7.4 Both parties must honor the Booking
7.5 Rooming Joe is not responsible for contractual disputes between Guest and Host
7.6 For Host-based services (e.g. rentals, hostel beds): when you accept a booking confirmation, you enter into a contract directly with the Host, who must provide the accommodation according to the terms of the listing, and you must pay the total amount due (including service fees, taxes, and any other applicable charges).
7.7 Properties/Hosts may have their own “Rules and Restrictions” (house rules, cancellation policies, additional fees, check-in/out requirements etc.). Those apply on top of these Terms, and you must accept them before booking.
- PRICING, PAYMENTS, & FEES
8.1 Pricing
Prices may include
8.1.1 Base nightly rate,
8.1.2 Taxes,
8.1.3 Cleaning fees,
8.1.4 Resort/occupancy fees,
8.1.5 Payment processing fees and
8.1.6 Rooming Joe service fees
8.2 Payments
Payments may be collected by:
8.2.1 Rooming Joe.
8.2.2 Hosts/Providers directly.
8.2.3 Third-party payment processors.
8.3 Service Fees
Rooming Joe may charge non-refundable fees for:
8.3.1 Processing bookings.
8.3.2 Providing customer support
8.3.3 Payment facilitation
- CANCELLATIONS, REFUNDS & CHANGES
Each Listing has its own cancellation policy and fees charged by rooming joe are non-refundable. Guests must read and accept the policy before booking.
Rooming Joe enforces the Host’s cancellation rules.
Host Cancellations:
If the Host cancels, Guest may receive:
9.1 A full refund minus any payment processing fees and Rooming joe’ s fees.
9.2 Alternative accommodation (when available). No credits are issued for the cancelled reservation.
No-Shows:
No-shows are non-refundable.
- SECURITY DEPOSITS & DAMAGES
Hosts may require security deposits and Guests are financially responsible for:
10.1 Property damage
10.2 Missing items
10.3 Excessive cleaning
10.4 Violations of house rules
Rooming Joe may:
10.5 Charge the deposit
10.6 Process Host damage claims
10.7 Mediate disputes but not guarantee outcomes
- GUEST RESPONSIBILITIES
11.1 You must comply with any applicable house/rules of the property (e.g. check-in/out time, occupancy limits, behavior rules).
11.2 If booking on behalf of others, you are responsible for informing them about the Terms and for their compliance as well as payment responsibility. They shave to produce a valid ID at check-in and kid should be accompanied by and always be with an adult.
11.3 Submitting any content (reviews, photos, messages, etc.) must comply with content guidelines; you grant the platform the right to use such content under applicable license/terms.
11.4 Guests must:
11.4.1 Follow Host rules.
11.4.2 Respect occupancy limits
11.4.3 Not damage property
11.4.4 Maintain cleanliness.
11.4.5 Not engage in illegal activities.
11.4.6 Avoid disturbing neighbors or other guests.
11.5 Misconduct may result in:
11.5.1 Immediate eviction
11.5.2 No refund
11.5.3 Account suspension
11.5.4 Damage charges
- HOST RESPONSIBILITIES
Hosts must:
12.1 Provide safe, legal, and sanitary accommodations
12.2 Maintain insurance where required.
12.3 Honor confirmed Bookings
12.4 Disclose hazards or restrictions.
12.5 Avoid discrimination.
12.6 Provide truthful Listing information
- INTELLECTUAL PROPERTY
Rooming Joe retains all rights to:
13.1 Website structure.
13.2 Branding.
13.3 Content.
13.4 Images (except Host-uploaded).
Rooming Joe restricts the following:
13.5 Copy, scrape, resell, or reverse-engineer the Platform.
13.6 Use automated tools without permission.
- USER CONTENT (REVIEWS, PHOTOS, MESSAGES)
If you submit content (reviews, photos, messages), you grant the platform and its affiliates a license to use, publish, modify, distribute or delete that content; you warrant that you have rights to submit it, and that it does not violate third-party rights.
You understand the platform is not responsible for verifying or endorsing user-submitted content or the accuracy/reliability of third-party content.
Any such violation may be reported to local, state or federal agencies for action.
Users must not post:
14.1 Fake reviews
14.2 Offensive or illegal content
14.3 Copyrighted material they do not own
- PRIVACY
Personal data is collected and processed according to the Rooming Joe Privacy Policy .
- DISCLAIMERS
Rooming Joe provides the Service “as-is” without warranties. We do not guarantee:
16.1 Accuracy of Listings.
16.2 Availability of accommodation.
16.3 Safety or legality of properties
16.4 Reliability of Hosts or Guests
16.5 Continuous or error-free Platform operation
Use of Rooming Joe’s portal is at your own risk.
- LIMITATION OF LIABILITY
To the maximum extent allowed by law, Rooming Joe is not liable for:
17.1 Damages caused by Hosts
17.2 Property conditions or safety issues
17.3 Booking cancellations.
17.4 Loss of personal belongings
17.5 Loss of income or business opportunity
Rooming Joe’s total liability is limited to:
(a) the amount paid by you directly to Rooming Joe for using the platform, or
(b) $200,
whichever is lower.
- INDEMNIFICATION
You agree to indemnify and hold harmless the platform, its affiliates, and employees (or the Host/Provider, when applicable) from any claims, losses, damages, or legal costs arising from your misuse of the Service, violation of the Terms, or breach of any agreement with the Host or Provider, Property damage, Illegal activities, Host/Guest disputes and Incorrect information provided.
- ACCOUNT TERMINATION
Rooming Joe may suspend or close accounts for Fraud, Abuse, Violations of Terms, Unsafe or illegal behavior, Chargebacks and Repeated cancellations or no-shows
Users may delete their accounts anytime.
- GOVERNING LAW (UNITED STATES)
These Terms are governed by:
20.1 United States federal law, and
20.2 The laws of the specific US state where Rooming Joe is registered (provide this for accuracy)
Disputes may be resolved by arbitration, mediation, or small court claims only.
- CHANGES TO TERMS
Rooming Joe may modify these Terms at any time.
Continued use of the Platform constitutes acceptance of updated Terms.
